Arbitration and Class Action Waiver Agreement:

Arbitration:

By using or purchasing Sew Arrogant products or services, you agree that any controversy, claim, action, or dispute between you and Sew Arrogant arising out of or relating to: (a) these Terms, or the breach thereof; or (b) your access to or use of Sew Arrogant ’s website or the services or the materials; or (c) any alleged violation of any federal or state or local law, statute or ordinance (each such controversy or claim, a “Claim”), shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association in accordance with its applicable rules.

Arbitration is a form of dispute resolution in which parties agree to submit their disputes and potential disputes to a neutral third person (called an arbitrator) for a binding decision, instead of having such dispute(s) decided in a lawsuit, in court, by a judge or jury trial. The arbitrator is obligated to issue a reasoned award in writing, including all findings of fact and law upon which the award was made. The arbitrator shall not have the power to commit errors of law, and the arbitrator’s award may be vacated or corrected through judicial review by a court of competent jurisdiction. Each party’s attorneys’ fees, expert costs, and other costs and expenses incurred in connection with arbitration will be borne by the party incurring such costs and expenses. 

Arbitration Procedures:

Claims shall be heard by a single arbitrator. Arbitrations shall be held in Orange County, FL, USA, but the parties may choose whether to appear in person, by phone, or through the submission of documents. The arbitration shall be governed by the Federal Arbitration Act (“FAA”) and by the internal laws of the [State], without regard to conflicts of laws principles. Any disputes in this regard shall be resolved exclusively by an arbitrator. If, but only if, the arbitrator determines the FAA does not apply, New York law governing arbitration agreements will apply. All disputes with respect to whether the foregoing mutual arbitration provisions are unenforceable, unconscionable, applicable, valid, void or voidable shall be determined exclusively by an arbitrator, and not by any court.

Exclusion from Arbitration:

Notwithstanding the terms of this Arbitration Agreement, you may choose to pursue a Claim in court and not by arbitration if you opt-out of these arbitration procedures within 30 days from the date that you first purchase any of Sew Arrogant's products or services (the “Opt-Out Deadline”). You may opt out by mailing a written notification to 3923 Rosewood way Orlando, FL 32808. Your written notification must include (1) your name, (2) your address, and (3) a clear statement that you do not wish to resolve disputes through arbitration. Your decision to opt-out will have no adverse effect on your relationship with Sew Arrogant. You are responsible for ensuring Sew Arrogant’s receipt of your opt-out notice, and you therefore may wish to send a notice by means that provide a written receipt. Any opt-out request received after the Opt-Out Deadline will not be valid and you must pursue your Claim in arbitration.

Class Action Waiver:

You and Sew Arrogant agree that you may bring or participate in Claims against Sew Arrogant only in your respective individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. Unless both you and Sew Arrogant agree otherwise in writing, the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated and may not otherwise preside over any form of a representative or class proceeding. Notwithstanding any other clause contained in this Agreement, any Claim that all or part of this Class Action Waiver is unenforceable, unconscionable, void or voidable may be determined only by a court of competent jurisdiction and not by an arbitrator.

 

Deposits

Deposits are for custom orders with a value amount greater than $650 only. Your deposit is a portion of your balance, once your deposit is placed, your deadline is secure and your materials are ordered soon after, so deposits are non refundable. If you cancel your order after production is started, you lose your deposit along with any payments made.  Order greater than $650 requires an %60 deposit. Any order less than $650 must be made in full and a deposits aren't acceptable.

Consultations 

Every custom order requires a consultation. To reassure that all custom orders are placed correctly. Also to make sure that all customer needs and desires are met. All consultations are subject to a  non-refundable consultation fee.  Sew Arrogant no longer credit consultation fees towards orders. Consultations fees are non-transferable.

Custom orders isn't booked on a first come basics. Custom orders are booked basic on the date of your event. If you would like an earlier turn around time you can book a rush order. 

DESIGN INTEGRITY

Sew Arrogant does not duplicate other designers work, we create all our custom dresses, be it from Prom, Bridal or special occasion from scratch. Pictures provided by clients are used for inspirational purposes only. In order to keep the  integrity of our brand all designs and items that are created are exclusive to Sew Arrogant. We use our own patterns and sketch based off of the ideas and inspirations given to us from our private clients. We Will Not create half a garment or take credit for someone else's work. 

Color Swatch/Design

The color of an item in a picture may not accurately depict the actual color, however you can request a sample. If we have it in stock we will ship the next day A FEES WILL BE CHARGED, if we are ordering the fabric we will ship once the fabric arrives. Since there are different Shades of some colors, if you need a dark or lite version you can send us a screenshot of a googled image that best depicts the color and we’ll will try to match it close as possible. 

Accent Lace/Appliqués: (These are design details used in addition to the main design, used on sleeves, randomly throughout design or as a main attraction piece). Vendors may not have the exact appliqués in one season that they had in a previous season, used to create the look you see. In this case we will use our knowledge to choose the next best similar option to achieve the look.You can reference the difference in the accent lace of “Red & Yellow Tracy” & “Tracy” Design or the “Jai” & “Jai w/ split” design. The design of the dress, material and placement is the same, however the pattern/shape of the accent lace may differ in size/shape based on what is in stock at the time of purchase. This also applies to Crystal Appliqués used (ex. “Amiyah” & “Queen” Design). Any question? Include in your inquiry!

CUSTOM DESIGN REFUND POLICY

Custom made to measurement designs sales are FINAL. NO REFUNDS,  NO RETURNS & NO EXCHANGES. This includes items listed under the Gowns tab, and items listed as Pre-orders (Which are custom made). These items are cut and sewn and produced in our studio. Once your order is placed production begins. If you need to make a change to a custom order please email us at info@sewarrogant.com

BOUTIQUE RETURN/EXCHANGE POLICY

Boutique items, including Clothing, Jewelry, Shoes and Accessories, are non refundable. However these items are available for one time exchange within 7 days of purchase. Items must be unworn, free from perfumes or scents. Must be in good condition with original tags and proof of purchase. When returning an item for an exchange, please be sure to include the following in your package; Order Number and the size you are exchanging for. If your alternative size is out of stock contact us to discuss an alternative garment. If the return is shipped outside of the 7 day return window the customer's package will be returned to customer. We DO NOT cover return shipment cost. 

Pre-Order Gowns Policy

Policy Statement: This policy governs the pre-order process for gowns, including but not limited to prom gowns, where customers place orders in advance of the product's availability. The policy outlines the terms and conditions regarding refunds, shipping timelines, and other relevant matters.

Pre-Order Process:

  1. Pre-Order Placement: Customers may place pre-orders for gowns through our designated channels, including our website, authorized retailers, or other approved platforms.
  2. Payment: Full payment or a %60 deposit is required at the time of pre-order placement. Orders will not be processed until payment is received and confirmed.

Terms and Conditions:

  1. Refunds: All pre-orders are final and non-refundable. Once a pre-order is placed and payment is received, no cancellations or refunds will be accepted, except as required by law.
  2. Shipping Timelines: Pre-ordered gowns will be shipped within 30 days of the order confirmation date, subject to availability and any unforeseen circumstances that may delay shipping. Customers will be notified promptly of any delays beyond the specified timeline.
  3. Availability: While we make every effort to ensure accurate inventory management, pre-order availability is subject to change based on factors beyond our control, such as supplier delays or production issues. In the event that a pre-ordered gown becomes unavailable, customers will be notified, and alternative options or refunds may be offered at our discretion.
  4. Communication: We will maintain open communication with customers throughout the pre-order process, providing updates on order status, shipping timelines, and any other relevant information.
  5. Quality Assurance: Pre-ordered gowns undergo rigorous quality control checks to ensure they meet our standards before shipping. In the rare event that a quality issue is identified upon receipt of the gown, customers should contact customer service promptly to address the issue.

Policy Compliance: Customers are responsible for familiarizing themselves with and adhering to this policy when placing pre-orders for gowns. By placing a pre-order, customers acknowledge their acceptance of these terms and conditions.

SHIPPING 

To ensure that your package is properly delivered and you receive shipment within the time frame we advertise, please make sure your address is fully entered and correct. If there are issues with verifying your address, customer service will contact you to try and resolve these issues. If after several attempts of contacting you, you do not respond, your order will be canceled and your money refunded to you boutique items only. If you realize that you entered your shipping address incorrectly, please contact us ASAP. If your tracking information states that your package was delivered and you have not received it, you must take this up with the United States Postal Service or FEDEX. Sew Arrogant DOES NOT hold responsibility for packages that state DELIVERED. We do not issue refunds for packages that state being delivered.

Account must be satisfied prior to shipping or this will delay the Shipping process

For Custom orders  please allow 3-4 weeks for production and shipping time. *Not including weekends and holidays. Rush orders requires express mailing fee. 

Boutique items are shipped within 3-7 business days. If you need a garment shipped sooner please place your order in enough time to receive it by your specific date. There is an additional fee for rush order shipments.

When your order has been shipped, you will receive an email with tracking information. We do not issue refunds for packages that state being delivered. Your shipping cost is displayed at point of checkout. International orders may be subjected to custom charges by your native country.

 

Cancelled Event: In the unfortunate event that your event is canceled, you are still responsible for the full total of the garments which should be paid no later then the Date of the event as recorded in our records. If the date is postponed, The balance will still be due by the original date provided. If the account isn't satisfied by then, the dress becomes property of Sew Arrogant and can be immediately sold for profit. (If a payment arrangement is needed please keep in contact with us)

WE WILL STORE DRESSES NO LONGER THEN 2 WEEKS AFTER YOU RECEIVE CONFIRMATION OF COMPLETION. AFTER THE 2 WEEKS A FEE OF $5 PER DAY WILL BE ADDED. AS WE CANNOT STORE DRESSES FOR LONG PERIODS OF TIME. IF LONGER THAN 4 WEEKS, ITEM BECOMES PROPERTY OF SEW ARROGANT AND CAN BE IMMEDIATELY SOLD FOR PROFIT TO FULFILL YOUR ACCOUNT.

Please note: We do not ship orders on Saturday or Sunday.

Prom Rush Orders Policy

The rush order service incurs an additional fee of $250 to prioritize and expedite the processing of the order.

Rush Order Process:

  1. Eligibility: The rush order service is available to customers who require expedited processing and delivery of their prom gown.
  2. Request: Customers interested in a rush order must explicitly request this service at the time of placing their order through our designated channels, including our website, authorized retailers, or other approved platforms.
  3. Rush Order Fee: A non-refundable rush order fee of $250 will be applied to the total order cost for customers availing the expedited service.

Terms and Conditions:

  1. Non-Refundable Fee: The $250 rush order fee is non-refundable, even in the event of order cancellations or returns. The fee is charged to cover the additional resources and efforts required to prioritize and expedite the processing of the order.
  2. Processing Time: Rush orders will be processed within an accelerated timeframe, with a commitment to ship the gown by a specified date agreed upon with the customer. The expedited processing time does not affect the shipping method selected by the customer.
  3. Availability: The rush order service is subject to availability and may be limited based on production capacity. Customers will be notified promptly if the rush order service cannot be accommodated for any reason.

Communication: We will maintain open communication with customers who opt for the rush order service, providing updates on order status, shipment tracking information, and any other relevant details to ensure a smooth and expedited process.

Policy Compliance: Customers availing the rush order service are responsible for understanding and adhering to the terms and conditions outlined in this policy. By requesting the rush order service, customers acknowledge their acceptance of the associated fee and terms.

SEWING COURSE POLICY

The course on sewing is non-refundable and requires active participation. There are no makeup days or excuses accepted. Please note that this course is the property of Sew Arrogant and should not be resold or shared. Violators will face consequences. Access to playbacks is granted, unless you have violated my policies, in which case you will be removed from the course without explanation or warranty. It is important to maintain a respectful and positive environment, as bashing and rudeness will not be tolerated. Difficult individuals will be removed without a refund. This course is private, and all information shared within should not be disclosed to anyone outside the course.

Policy, dates, and times are subject to change in accordance with the dynamic nature of the course. As we navigate through the course material and adapt to the evolving needs of the students, it is important to remain flexible and open to adjustments. We understand that unforeseen circumstances may arise, necessitating modifications to the established policies, dates, and times.
